Terms of Service

These Terms of Service are a legal agreement between you and Beijing Kemiyou Network Technology Co., Ltd. for your use of KomiU, including the App, website, account, profile, discovery, chat, safety, support, and paid token features.

1. Acceptance

By creating an account, signing in, using KomiU, or purchasing digital tokens, you agree to these Terms, our Privacy Policy, Community Guidelines, Content Moderation Policy, and any additional terms shown for specific features.

2. Eligibility

You must be at least 18 years old to use KomiU. You may not use KomiU if you are prohibited from doing so by law, if we previously terminated your account for serious violations, or if you provide false eligibility information.

3. Account rules

• You are responsible for keeping your account credentials, device, and verification codes secure.
• You may not sell, transfer, rent, or share your account.
• You may not impersonate another person, misrepresent your identity, or create accounts to evade restrictions.
• Apple and Google login options are provided through those providers. Their terms and privacy practices also apply to their services.

4. Profiles, chat, and user content

You are responsible for content you submit, post, send, or make available through KomiU. This includes profile text, photos, messages, reports, feedback, attachments, and other content.

You keep your rights in your content. You grant KomiU a worldwide, non-exclusive, royalty-free license to host, store, copy, display, transmit, format, adapt, moderate, process, and use your content as needed to provide, operate, secure, maintain and improve service reliability and functionality, and enforce the service. This license includes use for recommendations, profile display within KomiU, chat delivery, media processing, safety review, reports, dispute handling, and legal compliance. We will not use your private messages or private proof documents in external advertising without your separate permission.

You represent that you have the rights needed to provide your content and that your content does not violate these Terms, our Community Guidelines, or applicable law.

5. Community rules

You must follow our Community Guidelines. You may not harass, threaten, scam, exploit, impersonate, share illegal content, solicit minors, disclose private information without permission, misuse reports, automate abuse, or direct users to unsafe off-platform activity.

6. Safety and moderation

We may review, remove, restrict, downrank, hide, preserve, or report content or accounts when we believe it is necessary to operate the service, enforce policies, protect users, comply with law, or prevent abuse. We may use automated rules, user reports, manual review, account safety signals, and service logs. We do not guarantee that all harmful content or conduct will be detected.

7. Dating and offline safety

KomiU provides tools for adults to create profiles, discover people, and communicate. We do not guarantee user identity, background, intentions, compatibility, relationship outcomes, offline conduct, or safety. Use judgment when interacting with others, meeting offline, sharing personal information, or sending money. KomiU is not an emergency service.

8. Digital tokens and Apple In-App Purchase

For iOS, paid digital tokens are purchased through Apple In-App Purchase. Apple processes the payment and may handle certain refunds under Apple policies. Tokens are digital rights used inside KomiU. They have no cash value, are not legal tender, are not a deposit, are not transferable, and cannot be withdrawn, resold, or exchanged for money. Additional terms appear in the Token Purchase Terms and Refund and Token Return Rules.

Membership and exposure boost products are not offered in the current service unless separately made available and covered by additional active terms.

9. Account deletion and termination

You may request account deletion in the App. We may suspend, restrict, or terminate accounts that violate these Terms, create risk, or are required to be restricted by law. Account deletion or termination does not require us to delete records that we retain for safety, accounting, dispute, audit, fraud prevention, legal compliance, or other legitimate purposes.

10. App Store terms

If you downloaded KomiU from the Apple App Store, Apple is not a party to these Terms and is not responsible for KomiU or our content. Beijing Kemiyou Network Technology Co., Ltd., not Apple, is responsible for KomiU support, maintenance, product claims, and claims that KomiU or your use of KomiU violates another person's intellectual property rights, except to the extent Apple is responsible under applicable App Store terms. Apple and its subsidiaries are third-party beneficiaries of the provisions of these Terms that relate to your iOS app license, to the extent required by Apple. Your use of the App must also comply with applicable Apple terms.

KomiU is licensed, not sold. Subject to these Terms and applicable Apple terms, we grant you a limited, personal, non-transferable, non-sublicensable license to use KomiU on Apple-branded products that you own or control, and as otherwise permitted by Apple's usage rules. You may not copy, redistribute, sublicense, reverse engineer, disassemble, attempt to derive source code from, modify, or create derivative works of KomiU, except where applicable law or open-source license terms prohibit or limit those restrictions.

11. Third-party services

KomiU may interoperate with Apple, Google, Cloudflare, DigitalOcean, Google Workspace, and other service providers described in our policies. Third-party services are governed by their own terms and privacy practices.

12. No warranties

KomiU is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, safety, compatibility, and that any match, interaction, or outcome will occur. Nothing in these Terms limits rights or warranties that cannot be excluded under applicable law.

13. Limitation of liability

To the maximum extent permitted by law, KomiU and Beijing Kemiyou Network Technology Co., Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or user conduct. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, intentional misconduct, or personal injury caused by a party's legally actionable conduct where such limits are not allowed. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

14. Indemnity

You agree to indemnify and hold us harmless from third-party claims, losses, liabilities, damages, costs, and expenses arising from your unlawful content, your material violation of these Terms, your fraud or willful misconduct, or your violation of another person's rights, to the extent permitted by law.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, excluding its conflict of laws rules, except that mandatory consumer protection, privacy, and data protection laws of your place of residence may also apply.

Before filing a claim, either party must send written notice and try to resolve the dispute informally for 30 days. If the dispute is not resolved, any unresolved dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. The arbitration may be conducted by video, phone, written submissions, or in a location reasonably convenient for the consumer, as allowed by the AAA rules. Arbitration fees and costs will be allocated according to the AAA Consumer Arbitration Rules and fee schedule, and we will not require you to pay fees inconsistent with those rules.

Class, collective, consolidated, and representative actions are waived to the fullest extent permitted by law. If a court or arbitrator finds this waiver unenforceable for a particular claim, that claim must proceed only as allowed by law and the rest of this dispute section will remain in effect to the extent permitted.

16. Changes

We may update these Terms. If changes are material, we may provide notice through the App, website, email, or another appropriate method. Your continued use after the effective date means you accept the updated Terms.
